Civil Rights
While accidents involving negligence are commonly thought of as
"civil" claims, you also have the right to file a claim
for monetary and possibly punitive damages if your civil rights
have been violated. A civil right is an enforceable right or privilege which if interfered with
by another gives rise to an action for injury. Examples of civil
rights are freedom of speech, press, assembly, the right to vote,
freedom from involuntary servitude and the right to equality in
public places. Discrimination occurs when the civil rights of an
individual are denied or interfered with because of their membership
in a particular group or class. Laws have been enacted to prevent
discrimination based on a person's race, sex, religion, age, previous
condition of servitude, physical limitation, national origin and,
in some instances, sexual preference.
There are two primary mechanisms for protecting citizens' civil rights:
(1) Statutes that make certain types of discrimination unlawful and authorize
government agencies to act to prohibit violations of the rights granted in the
statute, and
(2) Statutes that allow individuals who have been harmed as a result of prohibited
discrimination to sue for money damages or injunctive relief if their civil
rights have been violated.
