Aviation Accidents
Aviation accidents account for a small percentage of serious injury and death
cases compared to other types of injury accidents. However the outcome
of an aviation accident is usually catastrophic to the victims and
their families. An injury or death that occurs in relation to aviation
calls for sound knowledge of aviation and its laws. Important legal
rights can be lost if these rules are not closely followed.
One of our attorneys, John Burns, is a former marine pilot, and airline captain.
Our clients have included persons injured in private and commercial
airplane crashes and in-flight accidents and we have been highly
successful in obtaining substantial recoveries for the injured people
we have represented.
After an aircraft injury occurs, a prompt investigation is critical to determine
the cause, whether the accident was the fault of the air traffic controller,
the pilot or the manufacturer, or was caused by improper maintenance. The right
investigation and evaluation often leads to a prompt resolution of the claim.
For example, one of the shortest deadlines arises when someone is injured or
dies due to the negligence of an air traffic controller. Since these persons
are employees of the United States Government, the claim is made against the
United States under the Federal Tort Claims Act and must be filed within 180
days from the date of injury. If this short claim filing deadline is missed,
the right to recover may be lost forever. Claims against the pilot may have
longer deadlines that vary depending upon the facts of the individual case.
An aviation injury or death requires specialized knowledge. Make
sure you have the right representation by an attorney who is truly
qualified in aviation law. Our experienced team of lawyers will
